Himalayan Academy (the publisher of this website and related apps) and its Digital Products and Services — including Hinduism Today in all its online and digital editions — does not sell, rent, or share information about its users with third parties.
Data handling in our native apps
Spiritual Workout app
The Spiritual Workout app stores all data locally on your device. Your mood entries, journal entries, and session history never leave the device and are accessible only to you.
Gurudeva app
The Gurudeva app stores preference data locally on your device. That data never leaves the device.
Other apps, websites, and services
Some of our apps and services store a user ID and activity history in the cloud. This information is linked only to a randomly generated ID and is not associated with your name, email address, or other personal information. We do not access personal information stored elsewhere on your device.
If one of our apps needs access to a device feature — such as the camera, location services, or microphone — it will request your permission before doing so.
Optional account information
Certain apps and services offer optional settings that let you provide information such as a username, email address, country, city, age, gender, birth date, phone number, and credentials for connected social networks. Providing this information may enable features like sharing to social platforms or receiving notifications.
The main practical benefit of providing a username and email address is recovery: if you lose your device or wipe its data, your journal entries, history, bookmarks, favorites, playlists, and custom settings can be restored. Without a username and email, this information will be permanently lost if your device is lost, replaced, or reset.
Information you provide for sharing to third-party services such as Facebook, X (formerly Twitter), or WhatsApp is stored on your device and is not transmitted to us. If you restore your settings on a new device, you will need to re-enter these credentials.
We do not release any of this information to third parties for any reason.
Terms of Service
These Terms of Service (“Terms”) apply to all Himalayan Academy Digital Products and Services that may run on your personal computer or mobile device, including our websites, PDF and ebook downloads, images, audio files, video files, and digital applications.
Please read these Terms carefully. Installing any of our apps on your personal computer or mobile device, or downloading any media from our websites, signifies your acceptance of these Terms and constitutes a binding agreement between you and Himalayan Academy. If you do not agree to these Terms, discontinue use of Himalayan Academy Digital Products and Services immediately. Our acceptance is expressly conditioned on your assent to these Terms.
Description of service
Himalayan Academy Digital Products and Services are produced and operated by Himalayan Academy (“we” or “us”). Use of these products is further subject to the End User License Agreement set out below.
Your account
Himalayan Academy Digital Products and Services may be used by individuals whether or not they have registered an account. If you register by providing a username, email address, and other personal information, you may not share your login credentials with anyone outside your household. You are responsible for maintaining the confidentiality of your account credentials, for restricting access to your device, and for all activity that occurs under your account, including the selection and use of all content and services.
User conduct
You may use Himalayan Academy Digital Products and Services only for lawful purposes and in accordance with these Terms, the End User License Agreement, and any operating rules established by Himalayan Academy. Himalayan Academy reserves the right, in its sole discretion, to refuse service or terminate accounts based on any activity that violates these Terms.
International users
Himalayan Academy Digital Products and Services are controlled, operated, and administered from our offices in the United States. If you access our services from outside the United States, you are responsible for compliance with all applicable local laws. You agree not to use our services or any media obtained through them in any country or in any manner prohibited by the United States Export Administration Act or other applicable laws and regulations.
Intellectual property
All content included in Himalayan Academy Digital Products and Services — including Hinduism Today magazine, text, graphics, logos, button icons, images, audio tracks, videos, and the compilation of all such material, as well as all software used on our sites — is the property of Himalayan Academy or its licensors (such as photographers, artists, and writers) and is protected by United States and international copyright laws. You agree to abide by all copyright notices and other restrictions contained in this content and not to alter them.
Himalayan Academy owns the copyright on its original content and holds distribution rights for some third-party content, including the magazines and other publications made available through our services (the “Media”). Except as expressly permitted by Himalayan Academy, downloading copyrighted material does not transfer any ownership rights to you.
You may print an unlimited number of copies of any publication, or portion of any publication, obtained through our services for your personal use or to share with family, friends, or colleagues. Except as permitted by copyright law or by these Terms, you may not modify, reverse engineer, publish, transmit by any means (electronic, mechanical, photocopying, printing, or otherwise), display, transfer, sell, create derivative works from, or commercially exploit any content from our digital products, websites, or Hinduism Today magazine without our express written permission. Personal social sharing through built-in app features is permitted.
We do not grant you any licenses, express or implied, to our intellectual property or that of our licensors except as expressly authorized by these Terms or the End User License Agreement.
Advertising and third-party content
Any opinions, advice, statements, offers, or other information expressed by third-party advertisers in publications offered through our services are those of the advertiser and not of Himalayan Academy. We do not guarantee the accuracy, completeness, or usefulness of any third-party advertisement content, and we are not liable for any loss or damage resulting from your reliance on advertising content.
Our digital products and services may contain links to third-party sites and resources. We do not assume responsibility or liability for the content, communications, or materials available through these linked sites. Such links are provided for your convenience only, and you are solely responsible for understanding any terms that apply when you visit a third-party site or place an order there.
Modifications to the service
We reserve the right to modify or discontinue, temporarily or permanently, any part of Himalayan Academy Digital Products and Services with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance.
Disclaimer of warranties
Himalayan Academy Digital Products and Services and all content are provided on an “as is” and “as available” basis. We expressly disclaim all warranties of any kind, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and noninfringement. Without limiting the foregoing, neither Himalayan Academy nor its affiliates, licensors, or agents warrants that:
- the service will meet your requirements;
- the service will be uninterrupted, timely, secure, or error-free;
- the results obtained from use of the service will be accurate or reliable; or
- the quality of any content obtained through the service will meet your expectations.
You are responsible for obtaining and maintaining reliable internet connectivity. Himalayan Academy is not responsible for your inability to download content.
Any material downloaded or otherwise obtained through our services is at your own discretion and risk, and you are solely responsible for any damage to your device or loss of data resulting from such downloads.
No advice or information, whether oral or written, obtained from us or through our services creates any warranty not expressly stated in these Terms.
Limitation of liability
In no event will Himalayan Academy or its affiliates, licensors, or agents be liable under any legal theory for any indirect, incidental, punitive, or consequential damages. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless Himalayan Academy, its licensors, suppliers, and third-party content providers, and their respective directors, officers, employees, and agents, from any claims, losses, expenses, damages, and costs — including reasonable attorneys’ fees — arising out of your use of our services, your violation of these Terms, or any activity under your account, including negligent or wrongful conduct by you or anyone accessing the service through your account.
Termination
Either Himalayan Academy or you may terminate this agreement at any time. Without limiting the foregoing, we may, in our sole discretion and without liability, terminate your account or your use of the service for any reason — including if we believe you have violated these Terms. Termination may take effect without prior notice, and we may deactivate or delete your account and all related information and bar any further access to the service. The sections covering intellectual property, disclaimer of warranties, limitation of liability, indemnification, and miscellaneous provisions survive termination.
Miscellaneous
These Terms, together with the End User License Agreement and any other rules, guidelines, licenses, and disclaimers posted on the Himalayan Academy and Hinduism Today websites, constitute the entire agreement between Himalayan Academy and you regarding your use of our digital products and services, and they supersede any prior written or oral agreements on this subject.
These Terms are governed by the laws of the State of Hawaii, without regard to its conflict-of-laws principles. No waiver of any breach or default constitutes a waiver of any preceding or subsequent breach or default.
Notification of changes
From time to time, we may revise these Terms to keep them current. Please check this page periodically. The “last updated” date below indicates the most recent change. Your continued use of our digital products and services after an update signifies your acceptance of the revised Terms.
End User License Agreement
By clicking “accept” when registering for Himalayan Academy Digital Products and Services, by installing our software, or by downloading any media from our websites or apps, you (or the entity you represent — “Licensee”) unconditionally agree to be bound by this License Agreement (“Agreement”). If you do not unconditionally agree to all of these terms, stop the download or installation process. Use of our software and files is also subject to the Terms of Service set out above.
1. License grant
Subject to the terms of this Agreement, Himalayan Academy grants Licensee a limited, personal, non-sublicensable, non-transferable, nonexclusive license to use the software you are about to download, install, or otherwise access (“Software”) and any magazines or other media files — such as images, PDFs, ebooks, and audio files — that you download from our digital products or websites, or otherwise access now or in the future (“Files”), solely for your personal use and in accordance with this Agreement and the Terms of Service. The term “Software” includes any underlying code, related documentation, and any upgrades, modified versions, updates, additions, and copies.
2. License restrictions
Except as expressly and unambiguously permitted by this Agreement, Licensee shall not, and shall not permit anyone else to:
- copy the Software (except a limited number of unmodified copies for personal use on devices owned by Licensee), modify it, or distribute it;
- reverse engineer, disassemble, decompile, or otherwise attempt to discover the source code or structure of the Software, except to the extent applicable law expressly prohibits such a restriction;
- rent, lease, or use the Software for timesharing or service-bureau purposes;
- use the Software or Files for any commercial purpose or on behalf of any third party.
Licensee shall not remove or obscure any proprietary notices on the Software or Files and shall reproduce such notices exactly on all permitted copies. As between the parties, title, ownership, and intellectual property rights in the Software and Files, and any copies or portions of them, remain with Himalayan Academy and its suppliers or licensors. Licensee understands that we may modify or discontinue the Software or Files at any time. The Software and Files are protected by United States copyright law and international copyright treaties. This Agreement grants no rights not expressly stated.
Licensee shall not export, import, or transfer the Software in violation of U.S. Export Administration Regulations or other applicable laws, and shall not facilitate any third party in doing so. By downloading or using the Software, Licensee represents that (a) no U.S. federal agency has suspended, revoked, or denied Licensee’s export privileges, and (b) Licensee is not located in, or a resident of, any country to which the United States has embargoed goods. All rights to use the Software are conditioned on compliance with this Agreement.
3. Intellectual property and user content
As a condition of using the Software and Files, Licensee represents, warrants, and covenants that Licensee will not use them to:
- infringe any third party’s intellectual property rights, proprietary rights, or rights of publicity or privacy;
- violate any applicable law, statute, ordinance, or regulation;
- disseminate content that is harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, or otherwise objectionable; or
- distribute viruses or any other code, files, or programs intended to interrupt, destroy, or limit the functionality of any software, hardware, or telecommunications equipment.
Licensee — not Himalayan Academy — remains solely responsible for all content that Licensee uploads, posts, shares, emails, transmits, or otherwise disseminates using the Software. All content Licensee accesses through the Software is accessed at Licensee’s own risk.
4. Support and upgrades
This Agreement does not entitle Licensee to any support, upgrades, patches, enhancements, or fixes (“Support”). Any Support that Himalayan Academy chooses to provide becomes part of the Software and is subject to this Agreement.
5. Warranty disclaimer
Himalayan Academy and its licensors provide the Software and Files “as is” and without warranty of any kind, and disclaim all express or implied warranties — including warranties of merchantability, fitness for a particular purpose, performance, accuracy, reliability, and noninfringement. We do not and cannot warrant the performance or results you may obtain from using the Software. This disclaimer is an essential part of this Agreement. Some jurisdictions do not allow limitations on the duration of implied warranties, so the foregoing limitations may not apply to you.
6. Limitation of liability
The Software and Files are provided free of charge. Under no circumstances and under no legal theory — whether tort, contract, negligence, strict liability, or otherwise — shall Himalayan Academy or its licensors be liable to Licensee or any other person for any indirect, special, incidental, or consequential damages of any kind, including damages for lost profits, lost savings, loss of goodwill, work stoppage, accuracy of results, or computer failure or malfunction. These limitations apply even if Himalayan Academy or its licensors have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so this limitation may not apply to Licensee.
7. Term and termination
This Agreement continues until terminated. Licensee may terminate it at any time. Himalayan Academy may terminate it immediately if Licensee violates any of its provisions. Termination of this Agreement also terminates all licenses granted under it. Upon termination, Licensee shall destroy and remove from all devices and storage media all copies of the Software and Files. Sections 2 through 8 survive termination.
8. Miscellaneous
This Agreement is the complete agreement between the parties regarding this license and supersedes all prior agreements and representations between them. It may be amended only by a writing signed by both parties or by Licensee’s acceptance of new terms published with an upgrade to the Software. If any provision is held unenforceable, it shall be reformed only to the extent necessary to make it enforceable. Himalayan Academy’s failure to act with respect to a breach by Licensee or others is not a waiver and does not limit our rights with respect to that breach or any subsequent breach.
This Agreement is personal to Licensee and may not be assigned or transferred for any reason — including by operation of law, merger, reorganization, or change of control — without our consent; any attempted assignment is void. Himalayan Academy may assign this Agreement or delegate any of its obligations. This Agreement is governed by Hawaii law, without regard to its conflict-of-laws provisions.
If any disagreement arises about this Agreement, the parties shall first attempt to resolve it by mutual agreement. Any remaining controversy shall be submitted to arbitration before a single neutral arbitrator in accordance with the rules of the American Arbitration Association, at Kauai, Hawaii. If arbitration cannot be held in Kauai, it shall be held in Honolulu, Hawaii.
